Terms & Conditions

TERMS AND CONDITIONS FOR USE OF THE CN Gaunt & Son Website: www.cngaunt.co.uk

These Terms will apply to all services provided by us to you, except as expressly varied by the CN Gaunt & Son.

DEFINITIONS 
You, Your: the person to whom we are providing the service/s.
We: CN Gaunt and Son 12 New John Street Westgate Bradford BD1 2QZ a partnership between Mr G Bovan and Mr J Metcalfe.

ACCEPTANCE OF TERMS    
By accessing the content of www.cngaunt.co.uk ("the Website") you agree to be bound by the terms and conditions set out herein and you accept our privacy policy available at www.cngaunt.co.uk/PrivacyPolicy. If you do not agree to any of the terms and conditions set out in this agreement or the privacy policy you should not use our services on the Website and leave immediately.

You agree not to use the Website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You agree that you shall not use the Website for illegal purposes and will respect all applicable laws and regulations. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

Your instructions give authority to CN Gaunt & Son or their agents to visit at the name and address supplied by you in order to collate information to prepare a report and/or to collect any monies due on your behalf and as your representative.

MODIFICATION    
CN Gaunt & Son reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement. CN Gaunt & Son have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

LIMITATION OF LIABILITY    
CN Gaunt & Son will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, loss of actual or anticipated profits, loss of opportunity, loss of goodwill, loss of reputation or loss of, damage to or corruption of data in relation to your use of the Website. Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of CN Gaunt & Son, its employees or agents.

INSTRUCTION/ SUBMISSIONS
In the event that you provide us with inaccurate information relating to the debtor's name or address and an attendance has been made, our attendance fee will be payable.

COPYRIGHT    
All intellectual property of CN Gaunt & Son such as trade names, trademarks, patents, registered designs and any other automatic intellectual property rights derived from the functionality of the Website remain the property of CN Gaunt & Son. By using the Website you agree to respect the intellectual property rights of CN Gaunt & Son and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website.

DISCLAIMERS    
The information is provided on the understanding that the Website is not engaged in rendering advice and should not be wholly relied upon when making any related decision. The information contained with the Website is provided on an "as is" basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website. We do not guarantee uninterrupted availability of the Website and cannot provide any representation that using the Website will be error free.

SEVERANCE
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force. Neither party shall be liable to the other for any failure or delay in performance of this agreement if it is due to any event beyond the reasonable control of that party.

PAYMENT
Where the Payment Terms provide for fees to be charged (see individual services), you will make all payments within 14 days of the invoice date, by cheque or bank transfer to our bank account, details of which are available on request. Where such payments are in conjunction with court fees, these fees must be paid immediately upon such instruction. Any delay in such payments may result in the service being provided, being deferred until CN Gaunt and Son receive the payment.

We will remit to you all cleared funds recovered on your behalf, after the 14 day statutory period, (s.184 and s.346 Insolvency Act 1986), funds are held in our client account and will be submitted after deduction of the statutory charges in respect of both fully and partly paid Writs. Where a part remittance is made 35% of the money recovered will be retained towards our fees, these fees have been added to the debt and are recovered from the debtor.

CARD PAYMENTS
Where we recover money on your behalf by means of a credit card or debit card payment, then we will endeavour to ensure that the payment is classed as "cardholder present", and in particular we will ask the cardholder to sign a form of authority for payment on the cardholder's card. If we are not able to obtain such a signed authority, and any payment is refused by the relevant credit card or debit card company within 12 months after payment was initially made, then we may give you notice of the refused payment, and you shall reimburse that payment within fourteen days of that notice.

GOVERNING LAW AND JURISDICTION
This Agreement will be governed by the laws of England and Wales, any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.
