If You've Had An Award But Not Been Paid...Here's What To Do

If you’ve been given an award, either from ACAS or from an employment tribuneral, and have not yet been paid, how do you go about recovering your money?

The good news if you find yourself in this position is that from April 2010, the process of enforcing Employment Tribunal cases and ACAS awards became more effective. An award can now be swiftly transferred into the High Court for enforcement, which is quicker and more effective.

The even better news is that we can handle this whole process for you – and not only that our service is completely free, the only charge is by the court for the transfer, this being £60.00.

Here’s how it works.

Step 1

You issue the award to C N Gaunts by giving us the details and instructing us to act on your behalf. You can do this online right now by simply filing in the Employment Tribunal Transfer Request form. Just click on the link or the icon at the top of the page to go directly to the form.

Step 2

We instruct our solicitor to obtain a County Court Judgment in your favour.

Step 3

We transfer the County Court Judgment up to the High Court so that we can enforce it.

At this stage, to seal the High Court Warrant, the Court charge a fee of £60:00 so a cheque has to be issued to cover this, please enclose a cheque payable to ‘HMCTS’ for the seal fee of £60.00 to cover this court fee.

Step 4

We visit the debtor to recover your money & pay you when we get it.

So, as you can see we really do make it as effortless as possible and take away all the stresses and strains of trying to do the recovery yourself.

How do you get paid?

Our costs are added to the award and recovered from the defendant.

What if I don't get paid?

It has been agreed with the Ministry of Justice that no fee will be charged for out of pocket expenses, therefore the case would be closed and you would not receive a bil.

What is the £60 for?

As mentioned above, Her Majesty’s Courts & Tribunals Service (HMCTS) charges £60.00 to seal the warrant. We do all the legwork and complete all the forms with no charge to you. This fee is then added to the judgment as an execution cost.

What Should I do if the defendant calls?

The most practical answer is to refer them to us, that the matter is being dealt with through the court and they need to contact the Officer.

What happens if I deal direct with the defendant

You will be liable for our full fees. We would ask you that once the enforcement process has started you refer the defendant to our office. The defendants regularly play one off against the other, delaying the payment.

How will I know what is happening on my case?

We will update you throughout all the processes; this can be done speedily through Email or written reports. This will include any offers made.

How soon will things happen?

As soon as you instruct. The transfer process is only restricted by the speed of the court and is out of our control, but once we have the sealed Order it is a matter of days before we attend.

As much as you have got, despite it seeming trivial.
