Transfer Up

Any County Court Judgment for over £600 (including costs) may be transferred to the High Court for enforcement, if the creditor chooses to use execution against the debtor’s goods as a method of enforcement (except where it is a judgment arising from a regulated agreement under the Consumer Credit).


FiFa Warrant

The FiFa warrant is the High Court equivalent of the County Courts Warrant of Execution – although its powers are considerably greater. It provides a command to seize/impound and sell debtor's goods and chattels to the value of the judgment debt, plus 8% per annum interest and costs.

How do I transfer my Judgment from the County Court to the High Court for Enforcement?

C N Gaunt & Son can transfer your Judgment for you.
All we would require is the Transfer UP Instruction Completing, (click here for Online Transfer Up Form or request a copy from our office), a copy of original Certificate of Judgment sealed by the Court, and a cheque for the sum of £60.00 payable to H.M.C.T.S.

We will complete all the necessary documentation, and prepare the warrant. We will issue it to the High Court and obtain the necessary seals and forward to the appropriate officer. The fee of £60:00 is the Court issuing fee and cheques sent should be payable to H.M.C.T.S.

How can I pay the fee for transfer up?

You can pay the fee in cash, debit card, bank draft, postal order, or cheque. Cheques are made payable to the H.M.C.T.S.
Account facilities are available upon request.

Will I get my transfer fee back?

When a High Court Warrant is issued there is a cost of execution fee of £111.75 which is payable, this fee is to cover your issuing costs. However if the High Court Enforcement Officer is not successful in obtaining payment, the issuing fees are not refundable.

After my judgment has been issued and my transfer complete what happens next?

A High Court Warrant will be issued to High Court Enforcement Officer who will attend the Defendant premises, usually within 72 Hours of the receipt of the warrant at their office. They will then report to you direct, as to the action which has been taken.

What happens if there are no assets?

If the Defendant has no assets, or only has assets that are not worth removing to sale and is unable to pay the warrant, a maximum fixed fee of £60.00 + Vat would be charged for up to three visits. The office would keep you advised of the progress by way of reports.

How long does my warrant last?

The warrant has a life span of 1 year. If the defendant is paying by instalments, or the year expires, we can make an application to the Court for the same to be extended for a further period. There is a further fee charged by the court of £45:00 to extend the warrant.

What happens if the warrant is unexecuted?

Should it be the case that the warrant can not be executed, for a variety of reasons, the defendant is insolvent, bankrupt, in liquidation or moved away and can not be traced. A maximum fixed fee of £60.00 + Vat would be charged as before.
