If you have obtained an Order for Possession in the High Court, you can simply send it to us and we will take immediate steps to enforce it. If you have obtained it through the County Court under trespass we can transfer the action into the high court using the transfer process. This is the same procedure as our transfer up of a judgment and has the same court fee of £60. Simply complete the online form and follow the process. Step 1 You issue the instruction to C N Gaunt and Son by giving us the details of the property. You can do this online right now by simply filling in Transfer Up Request for Possession form. Just click on the link or the icon at the top of the page to go directly to the form. Step 2 Attach a copy of the Order from the court to the transfer form together with a cheque payable to ‘HMCTS’ for £60 and post them to our office. We will process the paperwork and issue it to court for sealing, we then complete the following steps. Step 3 You will be assigned an Enforcement Officer who will liaise with you regarding the finer details and advise you of an enforcement date. Step 4 Our Officer will serve the occupiers. A risk assessment will be taken and we will advise the Police of our actions and liaise with them where necessary. Step 5 We will re-attend the premises the following day to ensure the trespassers have left and secure the site. Through your allocated Officer you are able to follow the process at each step, ensuring you are aware of the progress of your case. The key factor is speed, we act swiftly upon instructions and our experienced Officers will quickly take control and hand back your property, keeping you advised along the way.
